There are various issues across common-property areas at The Precinct. Through the recent Building Defects (Internal) action it was identified that the strata are unwilling to support any pursuit against the builder (BGC) for defects they consider as individual lot issues, and instead only common property issues.
In an effort to ensure that common property issues are dealt with in a timely manner by the strata, it is requested that anyone with knowledge of a common property defect please report it using the form below. We are collectively intending to submit a case to strata to manage a claim against BGC to rectify, after which if the strata reject handling the case we will need to:
- Collectively raise a case with BGC directly, and then to the Building Commissioners Office if BGC do not wish to engage
- Collectively raise a case with SAT for further review in relation to strata non-performance.
What is ‘common property’?
‘Common property’ is all areas of the land and buildings not included within the boundaries of an individual lot (your apartment). Please note that stacker car parks are considered common property even though they are assigned to individual lots.
What is and isn’t considered a ‘defect’?
Some examples of common property defects are:
- Water Ingress & Waterproofing: Leaking roofs, rising damp, or water penetrating through external walls or failed membranes in balconies, often causing damage to interior units.
- Structural Issues: Cracks in load-bearing walls, structural slab issues, or shifting foundations.
- Plumbing & Electrical Failures: Burst pipes, blocked sewage systems, and faulty wiring in common walls or servicing multiple lots.
- Building Envelope: Defective cladding, crumbling concrete, or deteriorating brickwork.
- Fire Safety Systems: Non-compliant fire doors, broken sprinkler systems, or faulty fire alarms.
- Common Areas & Amenities: Damage to driveways, boundary fencing, common gardens, or shared lighting.
Some examples of what are not considered common property defects:
- Fair Wear and Tear: Gradual deterioration from normal daily use or natural forces (sun/rain), such as faded paint, worn carpets in high-traffic areas, or minor scuffs on walls.
- Routine Maintenance: Issues arising over time that require regular upkeep, such as deteriorating external paint after several years, a light bulb failing, or a missing fire extinguisher.
- Individual Lot Property: Defects located within the boundaries of an individual lot (e.g., internal paint, private carpets, or fixtures like kitchen cabinets) are the owner's responsibility.
- **Minor "Standards & Tolerances" Issues:**Hairline cracks (non-structural), minor efflorescence (white staining on masonry), or slightly loose tiles that have not lifted.
